Order Receipt

The customer's receiving of an order confirmation from Affinity Systems, Inc. in any form does not indicate Affinity Systems' accepting of your order, nor does it establish validation of our offer to sell. Affinity Systems retains the right to decline your order for any reason at any time after receipt of your order. Affinity Systems retains the right to furnish less than the quantity ordered by the customer of any product at any time after the order has been received without prior notice to the customer. Depending on circumstances we may require supplementary information before processing any order.

Methods of Payment

Credit Cards - We accept the following credit cards: Visa and MasterCard. Credit card surcharges are included as part of the shipping and handling fees. When making a purchase be sure to provide your exact billing address and telephone number. This should be the address and phone number your credit card issuer has on file for you. Incomplete or inaccurate information may cause a delay in processing your order or may result in your order being rejected altogether. Your credit card will be billed at the time you place your order.

Cashier’s, Company, Personal Checks and Money Orders - Affinity Systems accepts cashier’s, personal, company checks and money orders in U.S. Dollars only. Orders payed by cashier’s, personal, company checks and money orders are processed upon receipt of the cashier’s, personal, company checks and money orders. Please allow approximately 10 business days after receipt for clearance of funds before the order is processed. Affinity Systems is unable guarantee the availability of an ordered product by the time funds are cleared or payment is received. To cover our cost we will charge a $25 administration fee on all returned checks.

Shipping

To cover our costs you will be charged $25.00 for any shipment that is refused. Shipments are made Monday through Friday. All shipments are subject to stock availability.

Please note that regardless of the delivery method used we will need one full business day to process your order. Sorry, no exceptions.

Please note that although we endeavor to ship the products you order out as soon as your order is placed after the one day required to process your order, choosing the Next Day delivery option does not mean your order will be delivered to you in 1 day from the time you placed your order.

You will receive the product(s) you ordered 1 day after the the order product(s) becomes available in stock. In other words, each product ordered will be shipped as it becomes available.

Sales Taxes

Affinity Systems will withhold the applicable sales tax for any orders to be delivered to the following states:

(1)California, (2)Massachusetts, and (3)Tennessee.

The customer is solely responsible for all taxes, sales or otherwise, on orders shipped to any state not listed above.

Returns

Return of products purchased hereunder because such products are claimed to be defective, shall be governed by Affinity Systems, Inc's Product Return policies or as otherwise provided by Affinity Systems, Inc. to the customer in writing. Affinity Systems, Inc. reserves the right to modify or eliminate such policies at any time. Although Affinity Systems, Inc.'s policies may permit the customer to return products claimed to be defective under certain circumstances, Affinity Systems, Inc. makes no representations or warranties of any kind with respect to the Products. Affinity Systems, Inc. HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESSED OR IMPLIED, AS TO THE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Affinity Systems, Inc. WILL NOT BE LIABLE FOR ANY DAMAGE, LOSS, COST OR EXPENSE FOR BREACH OF WARRANTY. The right to return defective products, as previously described, shall constitute Affinity Systems, Inc.'s sole liability and customer's exclusive remedy in connection with any claim of any kind relating to the quality, condition or performance of any Product, whether such claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise. In the event Affinity Systems, Inc. issues a return authorization to the customer allowing the customer to return product to Affinity Systems, Inc., the customer will deliver the product to Affinity Systems, Inc.'s address in the United States, if so required by Affinity Systems, Inc., and the customer shall bear all applicable federal, state, municipal and other government taxes (such as sales, use and similar taxes) as well as import or customs duties, license fees and similar charges, however designated or levied, on any replacement product to be shipped by Affinity Systems, Inc. to customer.

Software returns will be accepted for refund only if the product is unopened. Non-defective software that has been opened will not be accepted by Affinity Systems for return. Defective software may be returned for exchange with the same product only. All refunds for non-defective items exclude shipping and handling charges. If you are seeking replacement of a defective product, you must place a new order for the identical product. In order to receive a refund, your purchase must be returned with shipping pre-paid. All items must be in "as-new" condition, in original packaging and with all warranty cards, manuals and accessories. The original packing slip must be included and the RMA number visible on the package. Any discrepancies could result in a delay or partial forfeiture of your refund. There will be a $25.00 re-boxing fee for products not returned in the original manufacturer’s packaging. If part of a product becomes defective, the full product must be returned for credit or replacement.

Please send all returns via a courier that provides a tracking number.

If the productis not returned to us with all of the original material and packaging, it will be shipped back to you at your expense. If we conclude that the product is not defective, the product will be returned to you at your expense.

Warranties
